Terms of Service

1. Agreement to Terms

By accessing or using the Invisible College website (the "Site"), purchasing any products or services, or enrolling in any courses or classes, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Site or services. We reserve the right to update or modify these Terms at any time. Your continued use of the Site following any changes constitutes acceptance of those changes.

2. Description of Services

Invisible College is a collective of artists led by a poet. We offer online classes and courses, recorded course materials, merchandise, and other creative products and services through our Shopify-powered website. The specific offerings available may change from time to time at our discretion.

3. Account Registration

Some features of the Site may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as needed. You must notify us immediately of any unauthorized use of your account.

4. Purchases and Payment

All purchases made through the Site are processed via Shopify's secure payment platform. Prices for courses, recordings, merchandise, and other products are listed on the Site and are subject to change without notice. You agree to pay all charges incurred through your account at the prices in effect when the charges are incurred. All payments are in U.S. dollars unless otherwise stated. Sales tax will be applied where required by law.

5. Courses and Digital Content

When you purchase access to a course, class, or recorded material, you receive a limited, non-exclusive, non-transferable, personal license to access and view that content for your own personal, non-commercial use. You may not reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit our course content or recordings without our prior written consent. Live class schedules, formats, and instructors may be subject to change. We will make reasonable efforts to notify enrolled participants of any significant changes.

6. Refund Policy

Refund eligibility varies by product type. For digital products such as course recordings, refunds may be issued within 7 days of purchase if the content has not been substantially accessed. For live courses, refund requests must be submitted at least 48 hours before the first scheduled session. Merchandise returns and refunds are subject to our return policy as stated at the time of purchase. We reserve the right to deny refund requests that do not meet these criteria. To request a refund, please contact us at the email address provided on the Site.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, course materials, and software, is the property of Invisible College or its content creators and is protected by copyright, trademark, and other intellectual property laws. The Invisible College name, logo, and all related marks are trademarks of Invisible College. You may not use any of our intellectual property without prior written permission.

8. User Conduct

You agree not to use the Site or any of our services to: violate any applicable law or regulation; infringe upon the rights of others; share, redistribute, or resell course content or recordings; disrupt live classes or the experience of other participants; upload or transmit viruses or other harmful code; attempt to gain unauthorized access to our systems; or harass, threaten, or harm other users or Invisible College staff and artists.

9. Community Guidelines

Invisible College fosters a creative, supportive community. Participants in live courses and classes are expected to treat fellow participants, instructors, and guest artists with respect and courtesy. We reserve the right to remove any participant from a course or class without refund if their behavior is disruptive, abusive, or otherwise violates these Terms.

10. Third-Party Services

Our Site is hosted on Shopify. Your use of the Site is also governed by Shopify's Terms of Service. We may use third-party services for payment processing, email communication, video hosting, and other functions. We are not responsible for the practices or policies of these third-party services, and we encourage you to review their terms and policies.

11. Disclaimer of Warranties

The Site and all products, services, and content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific outcomes from participation in our courses or classes.

12. Limitation of Liability

To the fullest extent permitted by law, Invisible College and its artists, instructors, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Invisible College, its artists, instructors, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your violation of these Terms or your use of the Site or services.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the courts located in New York, New York.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
